DMCA & Copyright Policy

AK Nation News ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to claims of copyright infringement committed using our website, aknationnews.com (the "Site").

1. DMCA Notice & Takedown Policy

If you are a copyright owner, or an agent thereof, and believe that any content on our Site infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing:

Required Elements of a Takedown Notice

A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright interest.
A description of the copyrighted work that you claim has been infringed, including the URL (web address) of the location where the copyrighted work exists, or a copy of the copyrighted work.

3. Processing of Takedown Notices

Upon receipt of a valid DMCA takedown notice, we will:

Remove or disable access to the allegedly infringing material promptly.
Notify the content provider, member, or user that the material has been removed or disabled.
Provide the content provider with a copy of the takedown notice so they may make a counter-notification, if applicable.

4. Counter-Notification Procedure

If you believe that your content was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to our Designated Agent. Your counter-notification must include:

Identification of the content that has been removed or to which access has been disabled, and the location at which the content appeared before it was removed or disabled.
A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content.
Your name, address, and telephone number.
A statement that you consent to the jurisdiction of the federal court for the judicial district in which your address is located (or New York County, New York, if your address is outside the United States) and that you will accept service of process from the person who provided the original takedown notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who filed the original takedown notice. If the original complainant does not file a court action within 10 business days, we will restore the removed content.

5. Repeat Infringer Policy

In accordance with the DMCA, we maintain a policy for terminating the accounts of users who are repeat infringers of intellectual property rights:

Three-Strike Policy: Users who receive three (3) valid DMCA takedown notices will have their accounts permanently terminated and will be banned from creating new accounts on the Site. We reserve the right to terminate accounts after fewer than three strikes in cases of egregious or willful infringement.

6. Good Faith Requirement & Misrepresentation Warning

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.

Warning: Filing a false DMCA takedown notice or counter-notification is a serious matter. Before filing a DMCA notice, please make sure that you actually own the copyright to the content in question and that the use does not fall under fair use or another legal exception.

7. Fair Use Notice

AK Nation News is a news commentary and media criticism platform. Content on this Site may contain copyrighted material that has not always been specifically authorized by the copyright owner. We make such material available for purposes of:

Commentary — Analysis and discussion of current events, news, and culture.
Criticism — Review and critique of media, sports, and public figures.
Education — Informing the public about topics of social and cultural significance.

We do not monitor all user-generated content before it is posted.

We have designated an agent to receive notifications of claimed infringement and have implemented a policy to address repeat infringers. Upon receipt of proper notification, we will act expeditiously to remove or disable access to infringing material.

9. User-Generated Content

Our Site allows users to post comments, chat messages, direct messages, and other content. By posting content on the Site, you represent and warrant that you own the rights to such content or have obtained all necessary permissions. You agree not to post content that infringes on any third party's copyright, trademark, or other intellectual property rights.

If we receive a valid DMCA takedown notice regarding content you posted, we will remove the content and notify you. Repeated violations may result in the termination of your account in accordance with our Repeat Infringer Policy above.
